Brian has had multiple seven and eight figure jury verdicts and has also successfully defended and zeroed out multi-million-dollar claims—all before juries.
Brian has been listed as a Thomson Reuters Super Lawyer by Texas Monthly magazine every year since 2003 and has also been consistently listed on Thomson Reuters’ Top 100 in Texas list. For the past 12 years in a row, Brian has been listed as one of the Best Lawyers in Dallas by D Magazine. Brian has been listed in Best Lawyers in America every year since 2019. Brian is a past recipient of the John Howie Award from the Dallas Trial Lawyers Association for the "Courageous Pursuit of Justice in the Face of Adversity" and the Don Keenan Award presented by the American Board of Trial Advocates Foundation. A cum laude graduate of SMU Law School, who also has degrees in accounting and an MBA, Brian, a tenacious advocate, has consistently won major court fights for private equity and venture capital groups, corporate officers and directors, physicians and surgeons, investment and real estate vehicles, commercial real estate enterprises, developers, general contractors, partnerships, high net-worth individuals, lawyers and law firms, investors, inventors, entrepreneurs, shareholders, small businesses, and large corporations, and oil and gas companies and executives, especially when there has been substantial financial risk and business exposure. With board certifications in Civil Trial Law by both the Texas Board of Legal Specialization and the National Board of Trial Advocacy and a separate board certification in Civil Pretrial Practice, Brian specializes in the areas of business torts, commercial litigation including but not limited to all forms of contract disputes, real estate, fraud and fraudulent transactions, fiduciary litigation including partnership disputes and the representation of lawyers and law firms, physicians and surgery centers, disputes over non-competes, trade secrets, partnership agreements, intellectual property, employment litigation, failed oil and gas transactions, and professional liability. Brian is currently serving another three-year term as a member of the Texas Pattern Jury Charge committee on business torts, consumer, and employment litigation—and is the chair of the breach of fiduciary duty sub-committee. Brian is a Past President of the Dallas Chapter of ABOTA, he is a National Board Representative for the Dallas Chapter of ABOTA, and he is a member of the TEX-ABOTA Board of Directors. Brian also has unmatched appellate experience at the highest of levels, having orally argued before both the United States and Texas Supreme Courts. Brian has also been lead counsel in complex appeals and orally argued before the United States Court of Appeals for the Fifth and Eighth Circuits, the Dallas, Fort Worth, Texarkana, Eastland, El Paso, San Antonio, Corpus Christi, and Amarillo courts of appeal. Of note, in 2013, Brian argued the landmark decision on Title VII retaliation in, Nassar vs. UTSW Medical Center, before the United States Supreme Court. On numerous occasions, Brian has been the Course Director, an instructor, and a prolific writer for the Texas State Bar's continuing legal education seminars on Business Torts, Fiduciary Litigation, Advanced Civil Trial, and Advanced Evidence. In his spare time, Brian enjoys spending time with his family, quail, pheasant, duck, and wing shooting, fly-fishing, and competing in marathons and triathlons.
